Terms of use

Planctus is a web and mobile application created by the University of Ottawa’s Canadian Francophonie Research Chair in Language Rights (the “Research Chair”). planctus facilitates the submission of complaints to the various commissioners’ offices and other bodies whose mission is to protect and enforce language rights in their respective jurisdictions.

The planctus application and website are provided free of charge by the Research Chair in the public interest.

These terms of use (the “TOS”) are agreed to by you (“you” or the “user”) and the Research Chair and govern the use of the planctus web and mobile application and their content (collectively “planctus” or the “application” or the “website”), which are the property of the Research Chair.

For the purpose of these TOS, “Research Chair” means its holder and the University of Ottawa.

1        General Information; No Legal Opinion

The information that appears in the planctus application and on the planctus website is provided as general information. It does not constitute and may not be considered to be legal opinions or advice intended for anyone or for any use.

While the Research Chair makes every effort to ensure the accuracy and truth of the information on this website, the Research Chair may not be held liable in any way for any damage that may be caused by the use of the planctus website or application. While the Research Chair consults reliable sources and believes that the information conveyed by the application is accurate and is updated regularly, the Research Chair offers no guarantee that the information is accurate or complete.

The Research Chair may revise, remove, modify, validate or change, in whole or in part, any material or information posted on the planctus website and in the planctus application.

Links to other websites or referrals to other organizations, products, services or publications are not necessarily endorsed by the Research Chair. The Research Chair may not be held liable for any damage, including any damage resulting from the transmission of confidential information via the Internet.

2          Privacy and Confidentiality

planctus does not retain any copies of the complaints or personal information transmitted via the application or website. planctus serves solely as a standard for language complaints and submission of complains to the various commissioners’ offices or other bodies authorized it is to receive them.

When complaints and personal information has been transmitted to the competent commissioners’ offices or other bodies, they remain confidential and protected by law. The commissioners’ offices and other bodies authorized to process language complaints may not disclose your name or information without your permission.

3          Intellectual Property

The text and images on this website are protected by the Copyright Act. No one may copy, redistribute, reproduce or republish any material taken from the planctus website or application in any form without the permission of the Research Chair.

4          Validity and Interpretation

The validity, interpretation and legal effect of these TOS are governed by and must be interpreted in accordance with the applicable laws of Ontario and Canada. The courts of Ontario sitting in Ottawa will have exclusive jurisdiction over any dispute connected with or relating to these TOS.

5          No Warranty

YOU USE planctus AT YOUR SOLE RISK AND PERIL. NO INFORMATION OR OPINION, WHETHER ORAL OR WRITTEN, PROVIDED BY THE RESEARCH CHAIR OR ITS REPRESENTATIVES SHALL CREATE ANY WARRANTY. THE APPLICATION AND THE WEBSITE, INCLUDING BUT NOT LIMITED TO THEIR CONTENT, ARE PROVIDED FREE OF CHARGE “AS IS” AND “AS AVAILABLE”, WITH ANY DEFECTS AND WITH NO WARRANTY. FURTHERMORE, TO THE FULL EXTENT PERMITTED BY THE APPLICABLE LAWS, THE RESEARCH CHAIR DISCLAIMS ANY WARRANTY, EXPRESS OR IMPLIED, RELATING TO THE APPLICATION, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, ABSENCE OF INTERFERENCE, COMPATIBILITY WITH COMPUTER SYSTEMS, INTEGRATION, AND WARRANTIES OF SECURITY, RELIABILITY, TIMELINESS, OR PERFORMANCE OF THE SERVICES, INCLUDING WARRANTIES ARISING FROM COMMERCIAL ACTIVITIES AND EXCLUSIONS OF SUCH WARRANTIES.

THE RESEARCH CHAIR DOES NOT GUARANTEE THAT planctus WILL ALWAYS FUNCTION WITHOUT DISRUPTIONS OR THAT THE APPLICATION WILL BE FREE OF ERRORS OR WILL BE SECURE OR FREE FROM ATTACKS, VIRUSES, HACKING, INTERFERENCE, ALTERATION OR OTHER BREACH OF THE SECURITY OF THE DATA, INCLUDING THE LOSS OF DATA. THE RESEARCH CHAIR MAKES NO REPRESENTATION OR WARRANTY REGARDING THE CONDUCT OF USERS OF planctus OR THE INFORMATION PROVIDED BY THEM. ANY MATERIAL OR INFORMATION DOWNLOADED OR OTHERWISE OBTAINED VIA THE USE OF THE APPLICATION IS AT YOUR OWN DISCRETION, AND YOU UNDERSTAND THE ASSOCIATED RISKS AND WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE, INCLUDING DAMAGE TO YOUR MOBILE DEVICE, OTHER EQUIPMENT OR COMPUTER SYSTEM, ACCESS TO THE INTERNET, DOWNLOADING OR POSTING DEVICE, OR LOSS OR CORRUPTION OF DATA THAT RESULTS OR MAY RESULT FROM YOUR USE OF planctus. INSOFAR AS PERMITTED BY LAW, THE RESEARCH CHAIR WILL NOT BE LIABLE FOR SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY NATURE, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE) OR PRODUCT LIABILITY OR ANY OTHER LEGAL THEORY, RESULTING FROM YOUR ACCESS, USE OR ABUSE, OR INABILITY TO USE, THE APPLICATION, EVEN IF THE RESEARCH CHAIR WAS INFORMED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY EVENT, THE TOTAL LIABILITY OF THE RESEARCH CHAIR TO YOU IN CONNECTION WITH ALL CLAIMS RESULTING FROM THE APPLICATION IS LIMITED TO TEN DOLLARS CAD IF A LAW LIMITS OUR ABILITY TO LIMIT AN OBLIGATION OR DISCLAIM WARRANTIES, THE LIMITATIONS ABOVE DO NOT APPLY TO YOU.
